General Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online shop by consumers and entrepreneurs.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity. An entrepreneur is a natural or legal person or a legally capable partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

These terms and conditions also apply to future business relations with entrepreneurs without us having to refer to them again. If the entrepreneur uses conflicting or additional general terms and conditions, their validity is hereby contradicted; they will only become part of the contract if we have expressly agreed.

2. Contractual Partner, Conclusion of Contract

The purchase contract is concluded with Weingut Müller GmbH.

By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction options provided in the ordering process. The contract is concluded when you accept the offer for the items in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation email.

3. Contract Language, Storage of Contract Text

The language available for concluding the contract is German.
The terms and conditions can be accessed at any time on this page.

4. Delivery Conditions

In addition to the stated product prices, shipping costs apply. Details on shipping costs can be found under the “Shipping Costs” button. We deliver our orders via parcel service or freight company.

5. Payment

The following payment methods are generally available in our shop:

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay via PayPal, you must be registered there, log in with your credentials, and confirm the payment instruction to us. After submitting your order in the shop, we instruct PayPal to initiate the payment transaction. Further information is provided during the ordering process. The transaction is carried out automatically by PayPal immediately afterwards.

SOFORT Transfer
After submitting your order, you will be redirected to the website of the online provider SOFORT Transfer. To pay via SOFORT Transfer, you must have an online banking account enabled for SOFORT Transfer with PIN/TAN, log in, and confirm the payment instruction to us. Further instructions are provided during the ordering process. The transaction is carried out immediately by SOFORT Transfer, and your account is debited.

6. Retention of Title

The goods remain our property until full payment is made.

7. Transport Damage

For consumers:
If goods are delivered with obvious transport damage, please report such defects immediately to the carrier and contact us without delay. Failure to report has no effect on your statutory rights, particularly warranty claims, but helps us enforce our claims against the carrier or insurance.

For entrepreneurs:
The risk of accidental loss or deterioration passes to you as soon as we have delivered the item to the carrier, freight forwarder, or other person designated for shipment. For merchants, the examination and notification obligations of § 377 HGB apply. If you fail to provide notice, the goods are considered approved unless the defect was not detectable during inspection. This does not apply if we have fraudulently concealed a defect.

8. Warranty and Guarantees

Statutory defect liability applies.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) which can be found here: http://ec.europa.eu/consumers/odr/. Consumers can use this platform to resolve disputes.
We are obliged to participate in dispute resolution before a consumer arbitration board for disputes with consumers regarding the existence of a contractual relationship. The responsible body is the General Consumer Arbitration Board of the Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in proceedings before this body.

10. Other Provisions

If individual provisions of the contract or these terms are invalid, this does not affect the validity of the remaining contract or terms. The rest remains unchanged.

For any disputes, the local and factual jurisdiction of the District Court A-3500 Krems is agreed.

The contract is governed by Austrian law, excluding the UN Sales Convention.

For consumer transactions under the Consumer Protection Act, section 13.2 does not apply. Section 13.3 applies with the limitation that under Art. 6 of Regulation (EC) No. 593/2008 (“Rome I”), special consumer protection laws of the consumer’s residence country may take precedence over Austrian law.

11. Legal Notice & Ordering Process

a) Shopping Cart / Legal Notice
Select the products you wish to order by clicking the “Add to Cart” button. You can change your selection at any time before submitting your order by adjusting quantities, removing items, or canceling the order. Click “Checkout” to proceed.

b) Checkout
Log in with your email and password if you already have an account, otherwise register as a new customer. Your data is collected, processed, and used in accordance with data protection regulations. No other use or sharing with third parties occurs.

c) Verify Billing Address / Choose Payment Method
Check your billing address and select your preferred payment method. Click “Next” to continue.

d) Verify Shipping Address / Choose Shipping Method
Check your shipping address and select your shipping method. Click “Next” to continue.

e) Complete Order / Terms and Privacy
You will receive an overview of your order: selected products, shipping and billing addresses, and your contact information. Check all information and read the terms and conditions and cancellation policy. You can only proceed if you agree to the terms and privacy policy (tick the box). By clicking “Buy,” you submit your order, making a legally binding offer, purchase intention, or paid order.
